Privacy

GymDaze collects only the information needed to provide the site, respond to requests, deliver resources, process purchases, and coordinate consultations. The information involved depends on what you choose to do.

Information you provide

• Contact forms collect your name, email address, selected topic, optional order or booking reference, and message.
• Cloudflare Turnstile processes limited browser and network signals to distinguish legitimate email form submissions from automated abuse. GymDaze sends the verification token and the request IP address when available. GymDaze does not include the submitted email address, contact message, or requested resource in its server verification request.
• Free-resource forms collect your email address and your required marketing choice. Marketing messages include an unsubscribe method.
• Stripe processes payment, billing information, and the delivery email for purchases and optional contributions. GymDaze does not receive or store full card details.
• Printful receives the shipping and order information needed to quote, print, and ship merchandise.
• Google Calendar and Google Meet process information you submit when you schedule or attend a consultation.

Program-builder sign-in and drafts

The program builder uses Google sign-in to verify your identity and email address. The builder requests identity and email access only; it does not request access to your Google Calendar, Drive, or contacts.

A necessary session cookie keeps you signed in for up to eight hours. GymDaze uses an identifier derived from your Google account to associate generation and retry records with you. Your email address and Google access tokens are not stored in that session or in those usage records. Signing out clears the session cookie and the current tab's builder draft.

Your training choices and program draft are stored in the current browser tab so you can recover from a refresh. They are sent to the GymDaze server when needed to generate, edit, restore, or export your program. The builder does not save programs or workout logs as account history. A signed program preview expires after eight hours; starting over or signing out clears the current tab's saved work. Downloaded PDF and Excel files remain on your device until you remove them.

Private generation records held by Netlify contain your derived account identifier, the current allowance month, the number of successful generations, and limited regeneration and retry records used to prevent duplicate charges and limit abuse. They do not contain your training choices, programs, or workout logs. Retry and regeneration details expire after seven days and are removed during subsequent generation requests. The monthly counter resets on the first at 00:00 UTC. Automatic deletion for inactive pilot accounts is not yet enabled, so those records can remain longer. Information stored in your browser

The site may store calculator values, unit preferences, and cart contents in your browser so they can be reused. This information stays on your device until you clear it through the site or your browser. It is not an account and should not be treated as secure storage.

Service providers and retention

Netlify hosts the site and private delivery records. Cloudflare provides email-form abuse detection through Turnstile. Resend sends transactional and opted-in marketing email. Stripe processes payments. Printful fulfills merchandise. Google provides program-builder sign-in, booking, and video meeting services. These providers handle information under their own terms and privacy practices.

• Transaction records may be retained for up to seven years, or longer when required by law.
• Support and consultation records may be retained for up to two years.
• Marketing contact information is retained until you unsubscribe. Minimal suppression records may be retained to honor that request.
• Contact messages may remain in Resend and the private GymDaze support inbox during the support retention period. GymDaze does not maintain a separate contact-form database.

GymDaze does not sell personal information and does not use it for cross-site advertising. GymDaze does not currently load GA4, Meta Pixel, or similar advertising trackers. This policy must be updated before those practices change.

The educational site is intended for people age 13 and older. A parent or legal guardian must make purchases or book consultations for a minor. Contact GymDaze through the contact formif you have a privacy request.

Terms and Conditions

By using GymDaze, you agree to use the site and its content lawfully. Educational content is available globally. Digital-only orders are available internationally wherever Stripe supports your payment. Orders containing physical merchandise, paid consultations, and optional contributions are currently offered only to customers in the United States.

Digital products

A digital purchase gives you a personal, non-transferable license to use the file. You may not share, resell, repost, redistribute, or use it as client-facing commercial material. Copyright and all other ownership rights remain with GymDaze.

The paid GymDaze anatomy PSD, Adobe Premiere Pro MOGRT, and DaVinci Resolve DRFX include a limited video-use license. You may use exported or rendered anatomy visuals in your own original videos, including monetized videos, and may use the supplied layers or controls to select the included muscle visuals. You may not modify the underlying artwork or template structure, share or sublicense the source files, resell or redistribute the source files or rendered anatomy as standalone assets, or use the purchase to create a competing template, stock asset, merchandise, handout, or other substitute product.

Accounts, availability, and payments

GymDaze may correct errors, update content, limit quantities, refuse invalid orders, or withdraw an offer before payment is captured. Prices are shown in US dollars. Applicable taxes are shown or collected at checkout when required. Displaying a price does not promise that automated tax calculation is active.

Optional contributions

“Say thanks” payments are voluntary, one-time contributions to support GymDaze. They are not charitable donations, are not tax-deductible, and do not buy ownership, membership, or a future service. A contribution attached to a free resource does not change the resource's free price or the terms that apply to that resource.

Marketing consent beside a contribution is optional, unchecked by default, and separate from payment and transactional delivery.

Consultation conduct and materials

Consultations are educational sessions. Recording is prohibited unless everyone gives advance written consent. If you submit training logs, messages, videos, images, or other materials, GymDaze may use genuinely deidentified general lessons for education. GymDaze will not publish the original files, recordings, identifiable quotations, or other identifiable material without separate written permission.

Governing law

These terms are governed by the laws of the State of Utah and applicable United States federal law, without regard to conflict of law principles. Nothing here removes a right that cannot legally be waived.

Refunds, Returns, and Cancellations

Digital products

Digital access is delivered after your order is confirmed. Digital sales are generally final, subject to any cancellation or refund rights that apply in your country. Downloading a file does not by itself waive those rights. GymDaze will correct duplicate charges and will replace or refund an unavailable or corrupt delivery that GymDaze cannot reasonably correct. An expressly stated exception or a legal right that cannot be waived also applies.

To request a cancellation or refund, use the contact form and include your order reference. Do not send payment card details.

Optional contributions

Completed voluntary contributions are generally final because they are not purchases of goods or services. GymDaze will correct duplicate or unauthorized charges and will provide any refund required by law. If a paid free-resource delivery cannot be completed, GymDaze will retry delivery or refund the contribution.

Made-to-order merchandise

Merchandise is made to order and is final for change of mind, incorrect size or color selection, or an address error supplied by the customer. A verified damaged, defective, misprinted, incorrect, or lost order qualifies for replacement. A refund is available only when replacement is unavailable or required by law.

Contact GymDaze within 30 days of the delivery date, or the latest expected delivery date for a lost order. Include the order reference and clear photos when requested so the problem can be verified.

Free consultations

The free consultation is limited to one booking per person. Repeat free-consultation bookings will be cancelled. The free session provides general fitness education and is not medical care, diagnosis, treatment, or physical therapy.

Paid consultations

You may cancel or reschedule once with at least 24 hours notice. Later cancellations and no-shows are nonrefundable. Arriving more than seven minutes late is treated as a no-show, and a late arrival does not extend the scheduled end time. If GymDaze cancels, you may choose a full refund or a rescheduled session.

Shipping

GymDaze merchandise currently ships only to valid United States addresses. Printful prints and ships each order. Available methods, prices, and delivery estimates are calculated for the complete cart before checkout and may vary by product and address.

Estimates are not guarantees. Production time, carrier delays, weather, holidays, address problems, and other events outside GymDaze control may affect delivery. Customers are responsible for entering a complete, accurate address and reviewing the order before payment.

If tracking reports delivery but the package cannot be found, check the delivery area and contact the carrier first, then contact GymDaze within the claim period if help is still needed.

Fitness and Medical Disclaimer

GymDaze and Nicholas DiVito provide fitness education, not medical care. GymDaze is not acting as a physician, registered dietitian, physical therapist, or other licensed healthcare provider. Content, calculators, programs, and consultations do not diagnose, treat, cure, or prevent any condition.

Calculator results and training recommendations are estimates based on the information and assumptions shown. Results are not guaranteed. Individual responses to exercise and nutrition vary.

Exercise involves normal risks, including strain and injury. You are responsible for choosing appropriate activities, loads, and progressions. Stop if you experience chest pain, fainting, severe shortness of breath, sudden weakness, or other concerning symptoms, and seek qualified medical help when appropriate. Ask a qualified healthcare professional before beginning or changing a program when your health, injury history, pregnancy, medication, or other circumstances make that advisable.
