How GymDaze operates
These policies explain how Nicholas DiVito, doing business as GymDaze, handles information, purchases, fulfillment, fitness guidance, and affiliate links.

GymDaze collects only the information needed to provide the site, respond to requests, deliver resources, process purchases, and coordinate consultations. The information involved depends on what you choose to do.
The site may store calculator values, unit preferences, and cart contents in your browser so they can be reused. This information stays on your device until you clear it through the site or your browser. It is not an account and should not be treated as secure storage.
Netlify hosts the site and private delivery records. Cloudflare provides email-form abuse detection through Turnstile. Resend sends transactional and opted-in marketing email. Stripe processes payments. Printful fulfills merchandise. Google provides booking and video meeting services. These providers handle information under their own terms and privacy practices.
GymDaze does not sell personal information and does not use it for cross-site advertising. GymDaze does not currently load GA4, Meta Pixel, or similar advertising trackers. This policy must be updated before those practices change.
The educational site is intended for people age 13 and older. A parent or legal guardian must make purchases or book consultations for a minor. Contact GymDaze through the contact formif you have a privacy request.

By using GymDaze, you agree to use the site and its content lawfully. Educational content is available globally, but paid digital products, physical merchandise, and paid consultations are currently offered only to customers in the United States.
A digital purchase gives you a personal, non-transferable license to use the file. You may not share, resell, repost, redistribute, or use it as client-facing commercial material. Copyright and all other ownership rights remain with GymDaze.
The paid GymDaze anatomy PSD and MOGRT include a limited video-use license. You may use exported or rendered anatomy visuals in your own original videos, including monetized videos, and may use the supplied layers or controls to select the included muscle visuals. You may not modify the underlying artwork or template structure, share or sublicense the source files, resell or redistribute the source files or rendered anatomy as standalone assets, or use the purchase to create a competing template, stock asset, merchandise, handout, or other substitute product.
GymDaze may correct errors, update content, limit quantities, refuse invalid orders, or withdraw an offer before payment is captured. Prices are shown in US dollars. Applicable taxes are shown or collected at checkout when required. Displaying a price does not promise that automated tax calculation is active.
Consultations are educational sessions. Recording is prohibited unless everyone gives advance written consent. If you submit training logs, messages, videos, images, or other materials, GymDaze may use genuinely deidentified general lessons for education. GymDaze will not publish the original files, recordings, identifiable quotations, or other identifiable material without separate written permission.
These terms are governed by the laws of the State of Utah and applicable United States federal law, without regard to conflict of law principles. Nothing here removes a right that cannot legally be waived.

Digital sales are final because access is delivered after payment. GymDaze will correct duplicate charges and will replace or refund an unavailable or corrupt delivery that GymDaze cannot reasonably correct. An expressly stated exception or a legal right that cannot be waived also applies.
Merchandise is made to order and is final for change of mind, incorrect size or color selection, or an address error supplied by the customer. A verified damaged, defective, misprinted, incorrect, or lost order qualifies for replacement. A refund is available only when replacement is unavailable or required by law.
Contact GymDaze within 30 days of the delivery date, or the latest expected delivery date for a lost order. Include the order reference and clear photos when requested so the problem can be verified.
The free consultation is limited to one booking per person. Repeat free-consultation bookings will be cancelled. The free session provides general fitness education and is not medical care, diagnosis, treatment, or physical therapy.
You may cancel or reschedule once with at least 24 hours notice. Later cancellations and no-shows are nonrefundable. Arriving more than seven minutes late is treated as a no-show, and a late arrival does not extend the scheduled end time. If GymDaze cancels, you may choose a full refund or a rescheduled session.

GymDaze merchandise currently ships only to valid United States addresses. Printful prints and ships each order. Available methods, prices, and delivery estimates are calculated for the complete cart before checkout and may vary by product and address.
Estimates are not guarantees. Production time, carrier delays, weather, holidays, address problems, and other events outside GymDaze control may affect delivery. Customers are responsible for entering a complete, accurate address and reviewing the order before payment.
If tracking reports delivery but the package cannot be found, check the delivery area and contact the carrier first, then contact GymDaze within the claim period if help is still needed.

GymDaze and Nicholas DiVito provide fitness education, not medical care. GymDaze is not acting as a physician, registered dietitian, physical therapist, or other licensed healthcare provider. Content, calculators, programs, and consultations do not diagnose, treat, cure, or prevent any condition.
Calculator results and training recommendations are estimates based on the information and assumptions shown. Results are not guaranteed. Individual responses to exercise and nutrition vary.
Exercise involves normal risks, including strain and injury. You are responsible for choosing appropriate activities, loads, and progressions. Stop if you experience chest pain, fainting, severe shortness of breath, sudden weakness, or other concerning symptoms, and seek qualified medical help when appropriate. Ask a qualified healthcare professional before beginning or changing a program when your health, injury history, pregnancy, medication, or other circumstances make that advisable.
